Brittany Cartwright is hoping to make her own rules when it comes to parenting her and ex Jax Taylor's son.
The Vanderpump Rules alum filed for divorce from her husband of five years on Aug. 27, requesting primary legal and physical custody of their 3-year-old Cruz in court documents obtained by E! News on the same day.
However, Brittany did note in her filing that she is open to Jax—who she married in 2019 after five years of dating—receiving visitation time for their child.
The 35-year-old also asked the court to terminate both her and Jax's right to spousal support and that they each be responsible for their own legal fees.
In addition, Brittany asked that all gifts she received during her marriage be counted as separate property from Jax, as well as any possessions she acquired after their date of separation, which was listed in her filing as Jan. 24.
Brittany first announced her breakup from Jax in February, sharing that they were "taking time apart" as she moved into another home to "take some space for the sake" of her mental health. (The couple's strained relationship was documented on the first season of their Bravo series The Valley.)
"Yes, marriages in general are very hard and I've had a particularly rough year this past year," she said on her and Jax's When Reality Hits podcast. "I don't know what the future holds, but right now my focus is on being the best mom to Cruz."
Jax also agreed that it was the right move to split, telling Andy Cohen on Watch What Happens Live in May, "Until I can fix myself and get to where I want to be, I can't be good for her."
In July, the 45-year-old entered treatment for mental health struggles.
"Working on getting better for you buddy," Jax captioned an Instagram photo of himself kissing their son at the time. "I love you."
